Loog Guitars accepts the following credit cards and forms of payment:



Debit cards issues by the financial services companies listed above are accepted.
Credit cards are generally charged only at the time the order is placed.

Loog Guitars partners with third-party payment processors such as PayPal to facilitate payments and other payments and the disbursement of funds to sellers.

Loog Guitars may share your personal or transactional information with those third-party service providers when it's necessary to process payments.

By using a third-party service, you may also be subject to an agreement with the third-party. For example, PayPal is a third-party service provided by PayPal Holdings, Inc. and is subject to the PayPal User Agreement.

Payment by Gift Card

When you use a gift card, we charge the card as soon as you place your order. If your purchase total is more than the value of your gift card, you can use another payment method to pay for the difference.
If your purchase total is less than the gift card's value, the gift card carries that remaining balance until you use it another time. If the item you want to purchase becomes unavailable, or it's on back order and you choose to cancel it before it ships, we send you a new gift card to cover the cost of the item, plus any applicable taxes and promotions. We don't add the value back to the original gift card.

Payment with a Promotional Discount

Some promotions, or special offers, require a discount code that you can type in during checkout. Before using any promotion, be sure to check its terms and conditions for specific guidelines and restrictions.

 

Loog Guitar App Terms of Use

These Terms of Use ("Terms") constitute a contractual agreement between Loog Guitars LLC. ("Loog," "Loog Guitars," "we," "us," etc.) and yourself, regulating your utilization of this site, site registration, or the use of the mobile app, online portal, electronic forms, surveys, and interactive exhibits associated with this site and our services (collectively referred to as the "Services").

By downloading, purchasing, using, or otherwise accessing any of our Services, you are expressly acknowledging and accepting these Terms. The entirety of our agreement encompasses these Terms, along with all order forms and policies incorporated herein by reference, including our Privacy Policy.

Should you dissent from these Terms, your use of our Services is prohibited. If you have already commenced using the Services, you are obligated to discontinue immediately. To partake in specific Services, you may need to download content, software, and/or agree to supplementary terms and conditions.

You confirm that you have perused and embraced these Terms, asserting your full capability and competence to enter into and adhere to their stipulations, representations, and warranties as delineated herein.

In the event that you, as a parent or guardian, provide consent for your child's utilization of the Services, you thereby commit to abiding by these Terms. Likewise, if you are a music teacher and grant consent for a child's registration with these Services, you affirm your authorization to do so and ensure compliance with applicable laws in your country.

 

  1. The Services

1.1. Loog Guitars Services offer enjoyable and user-friendly music learning and practice tools accessible through web and mobile applications, encompassing the following: (a) The Loog Guitar mobile app (referred to as the "App"); (b) Our website (referred to as the "Site"), and; (c) additional features, content, applications, and functionality of any nature currently provided or to be provided by Loog in the future.

1.2. Conditional upon your acceptance and continual adherence to these Terms and the Privacy Policy, you are granted permission to utilize our Services solely for your personal purposes. Unless explicitly mentioned otherwise, these Terms do not confer upon you any commercial license regarding the Services. No authorization or license is afforded for the distribution, public performance, or creation of derivative works based on any content accessed through the Services.

1.3. Your use of the Services is undertaken at your own risk and responsibility. Loog disclaims any responsibility and does not provide any warranties regarding the outcomes arising from the use of the Services, nor does it assure any specific results.

 

  1. User Account

2.1. Account Details. When establishing or revising an account, you may be requested to furnish Loog with specific personal details to enhance your overall experience and tailor your progress. This information will be handled and utilized with the utmost care in alignment with the Privacy Policy. It is agreed that you will provide accurate and comprehensive information to Loog and promptly update it in the event of any changes.

2.2. User ID and Passcode. Throughout the account creation process, you may be prompted to choose a password. You are prohibited from sharing the account or the Login Information, granting access to your account to others, or engaging in any activity that could compromise the security of your account. Maintaining the confidentiality of the login information is solely your responsibility, and you will be held accountable for all uses of such information. You are liable for any activities conducted through your account.

2.3. Should you become aware of or reasonably suspect any security breach, including but not limited to loss, theft, or unauthorized disclosure of the login information, you must promptly notify Loog at support@looguitars.com and update your login information.

2.4. Loog retains the right to revoke or reclaim any usernames at its discretion and for any reason, including, but not limited to, claims by a Third Party asserting that a username infringes upon their rights.

 

  1. Use Limitations

3.1. Account Constraints. Any use of the Services that breaches these Terms is strictly forbidden, may lead to immediate revocation of authorization to use the Services, and could result in liability for violations of the law. You agree not to, under any circumstances:

- Utilize the Services, whether intentionally or unintentionally, in connection with any violation of applicable laws or regulations, or engage in activities that encourage such violations.

- Post information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, or religiously offensive.

- Share through the Services any material or information that infringes upon copyrights, trademarks, patents, trade secrets, rights of privacy, rights of publicity, or any other rights of individuals or entities, or impersonates others.

- Use the Services or any part thereof for any commercial purpose without explicit written consent from Loog.

- Disrupt or attempt to disrupt the proper functioning of the Services or access or use the Services in ways not expressly permitted by these Terms of Use.

- Reverse engineer, decompile, disassemble, decipher, or attempt to derive the source code for any underlying software or intellectual property used to provide the Services without Loog's express written consent.

- Copy, modify, or distribute rights or content from any Services or Loog's copyrights or trademarks, or employ any method to copy or distribute the content of the Services except as specifically allowed in these Terms.

- Use your account for anything other than private, non-commercial purposes unless otherwise stated.

- Use your account for engaging in illegal conduct.

 

3.2. Account and Services Suspension and Termination. Loog reserves the right, without limiting other remedies, to limit, suspend, terminate, modify, or delete accounts or access to the Services or portions thereof if you, or if Loog suspects that you, are failing to comply with these Terms of Use or engaging in actual or suspected illegal or improper use of the Services, with or without notice. Account termination may involve disabling your access to the Services or any part thereof, including any content submitted by you or others.

3.3. Export Limitations. You may not use or export anything (including information) from the Site in violation of U.S. or other applicable export laws, regulations, or the Terms.

 

  1. Minors

4.1. Age Restrictions; Parental Approval. If you are under the age of 16, you must not use the Services without explicit consent from a parent or legal guardian. Individuals under 13 are prohibited from disclosing personal information without appropriate parental or legal guardian approval. You assume full responsibility for any unauthorized use of the Services by minors associated with your account.

4.2. Payments by Parents. If you are under the age of 18, you are not allowed to make payments without consent from a parent or legal guardian. Parents must safeguard their payment information, and Loog is not liable for any unauthorized payments. You are responsible for any use of your credit card or other payment instrument.

4.3. Restricted Access Features. Certain Services may include sections restricted to adults over the age of 16, intended exclusively for parents and/or Music Teachers of minors, and adult users utilizing our Services ("Restricted Areas"). These areas, generally named "Parents/Teachers Zone," may also be identified by a different but clear name, signifying it as a Restricted Area in each Service. Restricted Areas may encompass links for making payments and may grant permissions to share personal information with others (e.g., students sharing assignments with their Music Teacher).

 

  1. Teachers' Utilization

5.1. If you are employed or self-employed as a music teacher, we encourage you to integrate the use of our Services into your lessons, extracurricular activities, supplementary assignments, and any other strictly educational purposes within the scope of your teaching activities.

5.2. However, you are not permitted to impose additional charges for incorporating the Services into your teachings. To avoid any ambiguity and in alignment with the aforementioned, Loog does not provide guarantees and disclaims any responsibility for the outcomes resulting from the use of the Services.

 

  1. Subscription Charges

6.1. Certain Services are available free of charge, while additional Services may necessitate payment. In consideration of the right to use the Services under the terms outlined herein, you are obligated to pay subscription fees according to the amount and payment terms specified in your order form, which will be applicable to any additional subscriptions acquired during the subscription term.

6.2. Your subscription fees exclude taxes, levies, duties, or any similar governmental assessments of any kind (excluding taxes based on our income, property, and employees). You are responsible for the payment of all such taxes.

 

  1. User-Generated Content and Activities

7.1. Content Generated by Users. You have the option to upload, post, or otherwise contribute various types of information, including (but not limited to) data, text, software, photographs, graphics, video, messages, or other materials (such as IP addresses and personal information) in connection with the Services ("Your Content").

7.2. When providing Your Content, such as by uploading information, you affirm and warrant that Your Content is either: (a) entirely your original creation, or (b) you possess all requisite rights, titles, interests, and licenses to upload it. Additionally, you grant Loog and other users the right to download, distribute, and use Your Content under these Terms without violating any applicable license, restriction, or law, or causing potentially adverse consequences to any party involved, which you have not prominently disclosed in Your Content.

7.3. Upon providing Your Content, you grant Loog, its affiliates, third-party sublicensees, successors, and assigns, as well as users downloading Your Content under these Terms, a perpetual, nonexclusive, worldwide, royalty-free, fully paid-up, irrevocable license to: (i) use, copy, distribute, modify, and create derivative works from Your Content; (ii) publicly perform or display, license, and distribute copies of Your Content, modified Your Content, and derivative works of Your Content; and (iii) sublicense to third parties the aforementioned rights, including the right to sublicense to further third parties as necessary or advisable (as determined by us or another licensed person in its sole discretion) to enable Loog or another licensed person to fulfill its mission, advance its related operations, and manage the Services.

7.4. To enhance the Services, Your Content may be accessed as required to provide the service and disclosed to data processors acting on our behalf, as further detailed in our Privacy Policy.

7.5. We retain the right to remove Your Content if we believe it violates these Terms or could create liability for us.

7.6. Third-Party Content. The Services may include hyperlinks to third-party sites and display content and information from such third-party sites ("Third Party Content"). Loog permits the promotion of only child-safe, education/music-oriented Third Party Content via the Services. We do not exercise control over these third-party websites and applications. Therefore, we do not verify, endorse, or assume responsibility for the accuracy, currency, completeness, or quality of Third Party Content. Loog is not liable for any damages, errors, omissions, or results obtained from using such Third Party Content. Before sharing any Third Party Content or information with third-party providers, please review their terms of use and privacy policies.

7.7. On-site and In-app Activities. Our Services are provided "As-Is" and may change in terms of content, functionality, and services at our discretion and at any time. We reserve the right to modify or suspend specific activities, even if you have already started participating. For instance, we may suspend or alter a course or program or amend a course description at any time, even if you have already taken action based on it. Additionally, we or third parties may make corrections, changes, withdrawals, or other adjustments, including content or assistance on the Site, if necessary.

 

  1. Proprietary Rights

8.1. The Services, which encompass content, games, melodies, titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, and moral rights, constitute copyrighted works owned by Loog and its third-party licensors or providers, unless expressly indicated otherwise. Loog retains all rights, including intellectual property rights and other proprietary rights, associated with the Services.

8.2. Our Site, excluding Your Content and inclusive of names, logos, trademarks, and service marks (collectively referred to as "Marks"), along with any related or underlying technology and any modifications, enhancements, or derivative works thereof, are the property of Loog and its licensors. These assets may be protected by applicable copyright or other intellectual property laws and treaties. All rights not explicitly granted to you are reserved. The use of any of Loog's Marks without our prior written consent is unauthorized.

8.3. While much of the content available through the Services is not downloadable, such as copyrighted works that are not distributed or works of others that cannot be distributed, we may designate certain content as downloadable ("Available Content").

You may review, download, copy, distribute, and use the Available Content solely for your personal, non-commercial purposes. Selling the Available Content or distributing it for a fee is prohibited. You are not allowed to use or disclose it or the Site to any third parties except as expressly permitted by these Terms.

8.4. You acknowledge and agree that these Terms of Use do not transfer the ownership of any copyrights, trademarks, slogans, service marks, trade names, trade dress, or other proprietary rights in the Site or Content, or any part thereof, to you or any third party.

 

  1. Disclaimers and Limitations of Liability

9.1. Disclaimer of Warranties

9.1.1 The Services and all materials contained in them are provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied, including, but not limited to, the warranties of merchantability or fitness for a particular purpose.

9.1.2 It is important to note that you use the Services at your own risk and responsibility. Loog does not assume any responsibility or provide warranties for the outcomes resulting from the use of the Services, nor does it guarantee any specific results. Loog shall not be held accountable for any malfunctions or damages caused by the use of Services, downloadable files, and/or the installation of Services.

9.1.3 Some Services may not be compatible with all types of mobile devices and computers. You are solely responsible for acquiring a compatible device if you wish to use some or all of the Services offered by Loog.

9.1.4 Some jurisdictions may not allow the exclusion of implied warranties or limitations as specified here, and, to the extent permitted by law, such exclusions and limitations may not apply to you.

9.2. Limitation of Liability

9.2.1 To the fullest extent permissible under applicable law, Loog, its affiliates, and their respective officers, directors, employees, agents, licensors, representatives, and third-party providers will not be liable for any damages, including, without limitation, compensatory, consequential, incidental, indirect, special, or similar damages, arising from the use of, or the inability to use, the materials contained in the Services. This includes materials provided or supplied by Loog or any third party, damages for lost profits, loss of privacy or security, loss of reputation, lost opportunity or business, or failure to meet any duty (including, without limitation, any duty of good faith or lack of negligence or workmanlike effort).

9.2.2 Regardless, in no event shall Loog's liability to you for any and all claims, damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you, if any.

9.3. Indemnification

9.3.1 You agree to indemnify, defend, and hold harmless Loog, its affiliates, and their respective officers, directors, employees, agents, licensors, representatives, and third-party providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use by you. Loog reserves the right, at its sole expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will fully cooperate with Loog in asserting any available defenses.

9.3.2 The provisions in this section paragraph will survive any termination of your account(s) or of the Service.

9.4. Exclusive Remedy

9.4.1 Your exclusive remedy for any breach of these Terms (including, without limitation, the Privacy Policy) and for any aggregate damages due to you (or others related to you) by Loog or any of the third parties for any reason relating to any part of the complete Site will be, at our option: (a) substitution, correction, or replacement of all or part of the content or service causing your damage (if any); or (b) one hundred USD (US $100).

9.4.2 The damage exclusions and limitations in these Terms are independent and will apply even if any remedy fails of its essential purpose. Some jurisdictions may not allow the exclusion or limitation of liability as specified herein, and, to the extent permitted by law, such exclusions and limitations may not apply to you.

 

  1. Dispute Resolution

10.1 We strongly encourage you to contact us directly before resorting to litigation. Reasonable requests to resolve disputes through alternative dispute resolution procedures, such as mediation or arbitration, will be considered.

10.2 These Terms of Use and the relationship between you and Loog shall be governed by the laws of New York without regard to its conflict of law provisions. You agree to submit claims and disputes to the exclusive jurisdiction of the competent court in New York, US. You hereby waive any and all jurisdictional and venue defenses otherwise available.

10.3 You agree that, notwithstanding any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Services or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.

 

  1. Updates to These Terms; Conflicting Documents

11.1 Loog retains the right to change and/or modify these Terms of Use at its sole discretion. You do not have a continuing right to use the Site, and each visit subjects you to the version of the Terms in effect during your visit. Any such changes or modifications take effect immediately upon posting them to the Site or through the Services. You acknowledge and agree that Loog may update the Services with or without notifying you. By continuing to use our Services, you accept such changes and modifications in the Terms of Use.

11.2 If, due to changes or modifications in the Terms of Use or the Privacy Policy, you no longer agree to either of them, you must immediately cease using our Services.

11.3 In the event of a conflict between these Terms of Use and the Privacy Policy or any other Loog Terms of Use or policies, these Terms of Use shall prevail.

 

  1. General Provisions 

12.1 Assignment. You may not assign or delegate any rights or obligations under the Terms of Use or Privacy Policy without Loog's prior written consent. Any unauthorized assignment and delegation by you is void and ineffective.

12.2 Entire Agreement. These Terms of Use constitute the entire understanding between you and Loog, superseding all prior understandings, whether electronic, oral, or written, or established by custom, practice, policy, or precedent, between you and us regarding the Services.

12.3 Severability. If any portion of these Terms of Use is found illegal or unenforceable by any court of competent jurisdiction, such provision shall be ineffective to that extent without affecting the validity or enforceability thereof in any other manner or jurisdiction. The remaining provisions shall continue to be in full force and effect.

12.4 Notices. We may notify you via email or by posting on the Site. All notices given by you or required from you under these Terms of Use shall be in writing and addressed to: support@loogguitars.com. Notices that you provide without compliance with this Section on Notices shall have no legal effect.

Loog Guitar App Payment Policy

  1. Paid Content

   You can access certain parts of the Services for free, while other sections require payment for subscription and/or other fees ("Paid Content"). Fees may be one-time payments or automatically renewing payments, as detailed in the respective Services platform(s). By opting to access, purchase, or subscribe to any Paid Content, you authorize Loog to charge your credit card or chosen payment method for all costs and charges associated with such Paid Content. You are responsible for all applicable fees, charges, taxes, and subscriptions incurred, and for any purchases made using your account. If you act on behalf of an entity, you confirm that you are authorized to represent that entity. Loog may use a third-party payment processor, and if you make a purchase through a third-party application store, the applicable payment policies of that Third Party will apply.

  1. Payment Information

   To access Paid Content, you must provide valid and accepted payment information. If your provided payment information is declined, you must provide alternative valid information, or your access to Paid Content may be suspended at Loog's discretion. Upon processing and approval of the provided payment information, you will regain access to Paid Content.

  1. Trials

   Loog may offer trial periods for Paid Content at its discretion. During a trial period, you may access the Paid Content without payment or at a reduced rate. Loog reserves the right to determine eligibility, cancel, or modify trial terms without notice. If you do not cancel your subscription before the trial period ends, you agree to automatic charges for the Paid Content, starting on the first day following the trial period, on a recurring basis until you cancel. 

  1. Billing, Renewals, and Cancellations

   Subscription fees may be billed as one-time payments or monthly installments. Renewals occur automatically, and if your subscription started with a promotion or trial, renewal rates may differ. You may receive a full refund within thirty (30) days of subscribing to Paid Content if you have not accessed it during that period. Auto-renewable subscriptions automatically renew, and payment is charged using the provided information unless canceled before the current subscription period ends.

  1. Promotions and Types of Subscriptions

   Subscription pricing and terms may vary based on promotions, subscription type, and duration. If your subscription began with a promotion or trial, renewal rates may differ. Payment billing dates or terms may change if a payment fails on the original due date.

  1. Modifications

   Loog reserves the right to modify subscription fees with 30 days' notice. You may cancel your subscription within this notice period to avoid modified fees. Loog may also add or cancel free or paid Services at its discretion.

   6.1. Payment transactions are conducted through a trusted payment solution site, with no payment information collected, processed, or saved by Loog.

   6.2. You can cancel auto-renewing subscriptions through your account settings or by contacting support. Payments made to Loog are final and non-refundable unless explicitly stated otherwise.

  1. Price Changes

   Loog may change prices and fees, notifying you in advance. Price changes take effect at the beginning of the next subscription period. Continued use after a price change indicates acceptance.

  1. Collection

   If Loog cannot collect subscription fees, it may take necessary steps for collection, and you are responsible for associated costs.

  1. Late Payments

   In case of late payments, interest may be charged, and if payment failure persists, services may be suspended. Subscription fees are non-cancelable and non-refundable.

  1. Free Services for Teachers

    Some Services are free for registered teachers and their students. Loog may change this offering at its discretion, with changes taking effect immediately after posting or providing notice to users.
